TERMS AND CONDITIONS

These Terms and Conditions apply to the AP Lotion Challenge organized by the Company.

1. DEFINITIONS:

• "Coslab" and "Arena Beauty Trading Pte. Ltd." are together referred to as the "Company".
• "Participant" refers to any individual who submits their content for the challenge.
• "Materials" means any content, including but not limited to photographs, recordings, videos, featuring the participant, created by or for the Company.
• "Challenge" refers to the promotional event where Participants participate by submitting their materials after using the AP Lotion.

2. PARTICIPATION AND SUBMISSION CRITERIA:

• Eligibility: Only individuals who have made a purchase of the 30ml AP Lotion via the Company’s official website, www.coslab.com.sg/shop, are eligible to participate in the Challenge. The 150ml AP Lotion is not eligible for this Challenge.
• Submission Requirements: Participants are mandated to:
  1. Photograph their skin daily for a consecutive period of 7 days.
  2. Record and submit a 10-second video featuring the participant posing and smiling with the AP Lotion.
  3. Complete the submission form with their order number, personal particulars, and upload their photographs & video, adhering to the submission guidelines.
  4. Agree to these terms and conditions.
• Reward:
  • Submissions that adhere to the stipulated guidelines and are successfully verified will entitle the participant to a full refund of the AP Lotion purchase. This refund is limited to the first 50 verified participants of the Challenge.
  • Each order is eligible for only one refund.
  • Each participant is allowed only one entry into the Challenge. Multiple entries will not be accepted.
  • The reward will be refunded to the account from which the order was made. The refund process will be completed within 14 business days after the submission is successfully verified.
  • Participants will be notified of their submission's verification status and the refund status (if applicable) via a WhatsApp message and an email.

3. INTELLECTUAL PROPERTY AND USAGE RIGHTS:

• Ownership: All rights in the Materials, inclusive of all intellectual property rights, shall belong exclusively to the Company.
• License: By participating, the Participant grants the Company, its affiliates, and assignees an exclusive, worldwide, royalty-free license to use all Materials submitted by the participant, in any manner, form, or format whatsoever now or hereinafter created, including on the internet, for any lawful purposes, including but not limited to advertising or promotion of the Company, without further consent or remuneration to the participant. This applies to all participants, except those who are disqualified, irrespective of whether they are among the first 50 verified participants or not.

4. PERSONAL DATA AND MARKETING USAGE:

• The Company may use the Participant's name (or part thereof), age, and gender for marketing or promotional purposes.

5. PARTICIPANTS BELOW 18 YEARS OF AGE:

• Parental Consent: Participants under the age of 18 are required to obtain the consent of their parent or guardian before submitting their Materials.
  1. The Company reserves the right to contact the parent or guardian of any Participant below the age of 18 for confirmation of the given consent. This may include a phone call for verification purposes.
  2. If it is found that the parent or guardian did not approve the participation, all information pertaining to the submission, including any media uploads, name, and other personal details, will be immediately deleted from the Company's records.
  3. Failure to furnish verifiable consent, or if it is discovered that consent was not given, will result in the disqualification of the Participant from the Challenge and a forfeiture of any potential benefits or rewards arising from participation.
  4. In the event the Company is unable to contact the parent or guardian within 14 days of attempting to verify consent, the participant will be disqualified from the Challenge.

6. DISCLAIMERS:

• The Company reserves the right to amend these terms and conditions or to cancel the Challenge at any time without prior notice.
• The decision of the Company concerning any aspect of the Challenge, including the eligibility of entries, will be final and binding.
• Participants indemnify the Company against any claim, loss, damage, cost, or expense resulting from a breach of these terms and conditions.
• The Company is not responsible for any adverse reactions or effects resulting from the use of the AP Lotion. Participants are advised to perform a patch test or consult with their dermatologist before full application.
• The Company and its associates reserve the right to verify the authenticity of submissions and may disqualify any participant if there's reasonable belief of inauthentic or tampered submissions.
• Participants represent and warrant that their submitted content is original, truthful, and does not infringe on any third-party rights.

7. DATA PROTECTION:

• The Company will adhere to the Personal Data Protection Act (PDPA) of Singapore in the handling, storage, and use of personal data collected during the Challenge.
• By participating, participants consent to the collection, storage, and use of their personal information by the Company for the purpose of this Challenge and for any other lawful marketing purposes.

8. TERMINATION AND EFFECTS:

• The Company reserves the right to terminate or suspend the Challenge at any time. In the event of termination, all participants acknowledge and agree that they will not be entitled to any compensation for their participation.

9. DISPUTE RESOLUTION:

• In the event of any disputes arising out of or in connection with these terms and conditions, both parties agree to first attempt to resolve the matter through mediation in Singapore, before resorting to litigation.

10. GOVERNING LAW:

• These terms and conditions shall be governed by and construed in accordance with the laws of Singapore. All participants hereby submit to the exclusive jurisdiction of the courts of Singapore.
